Consultation of the pages on this website and, where applicable, use of the mobile application (hereinafter collectively referred to as the "Digital Platform"), as well as registration on the Klépierre platform, implies the user's unconditional acceptance of these terms and conditions. Klépierre reminds users that some of the services offered by the Digital Platform have specific terms of use that complement these general terms and conditions.
Purpose of the Digital Platform
The aim of the Digital Platform is to provide general information about the ROMAEST shopping center, the products sold, and to allow users to register on the Klépierre platform. Users are permitted, through the use of the Platform or the Mobile App, to share and publish content on the platform itself and/or on the connected social networks. In no way do the information contained in the Digital Platform constitute an offer to enter into a contract, an offer to purchase, or an offer to sell, unless otherwise specified.
Access to the Digital Platform
Klépierre Management cannot guarantee that the platform will operate without interruptions or errors. It is solely committed to the obligation of means concerning the operation and continuity of the Digital Platform and the services offered. Subject to legal limits, Klépierre Management cannot be held responsible for any loss resulting from the Digital Platform, regardless of its cause; in particular, Klépierre Management cannot be held responsible for any fraudulent use of data and/or the accidental transmission of viruses through the Digital Platform. Similarly, it cannot be held responsible for situations attributable to force majeure, breakdowns, or technical issues related to hardware, platforms, software, or the Internet network, which may lead to the suspension or partial interruption of the Digital Platform. Klépierre Management reserves the right to modify, suspend, limit, or interrupt access to all or part of the Digital Platform without prior notice. This may occur at any time, especially during updates or maintenance of the Platform.
Registration on the Klépierre Platform
3.1 Access and Registration on the Platform The website and, where applicable, the Application provide users with access to the Klépierre platform. Each user wishing to register on the Klépierre platform must read and accept these general terms and conditions. By clicking the "I have read and agree to the General Terms and Conditions of Use" box, the user acknowledges acceptance and compliance with these terms of use. The platform does not allow multiple registrations using the same data. During registration on the Platform, the User must provide their age through the tools provided by the platform. The system is set up to prevent registration by individuals who provide an age below the legally permitted limit.
3.2 Registration Registration on the Klépierre platform, set up by Klépierre Management, allows users to:
Benefit from promotional offers, the terms of which are specified for each one;
Receive the Klépierre platform newsletter;
Access the services on the Digital Platform reserved only for Klépierre platform members;
Publish comments on articles posted in the dedicated sections of the Digital Platform.
3.3 Registration Process To register on the Klépierre platform, the user must complete an online subscription form on the Digital Platform, specifying the required information. In particular, users must choose a username and password to access their personal account. An email will be sent to the user confirming the registration at the email address provided on the form. Registration qualifies the user as a registered user of the Klépierre platform, providing them access to the services listed in point 3.1. Registered users of the Klépierre platform can modify their information at any time through the "My Account" page. They can also request to cancel their registration by sending a request to the following address: info@romaest.it.
3.4 Information Provided During Registration If the required information is not provided, the registration process on the Platform cannot be completed. The user agrees to ensure that the information provided in the registration form is complete and accurate. Any registration containing obviously incorrect information will be removed at the sole discretion of Klépierre or another designated party. In addition, users agree to keep their username and password strictly confidential. Any connection using the username and password of the user will be considered as made by the user. In case of fraudulent use, loss, destruction, or theft of the username and password, the user is required to change them as soon as possible on the Digital Platform. Klépierre Management cannot be held responsible for the consequences of such fraudulent use, loss, destruction, or theft. Klépierre Management, subject to mandatory legal limits, may decide to suspend or exclude a user in case of a violation of these general terms and conditions.
3.5 Obligations of Registered Users Each registered user of the Klépierre platform agrees to:
Create and use only one account;
Provide truthful and up-to-date information;
Use respectful and non-offensive language towards other users on the Digital Platform;
Comply with the specific terms and conditions applicable to each offer or transaction proposed on the Digital Platform.
3.6 Content Publication Users of the Klépierre platform may be offered the opportunity to post comments on articles published in the dedicated sections of the Digital Platform. Users are solely responsible for the content of their posts on the Digital Platform, as well as the texts and/or opinions they express. Users agree to ensure that the content and/or texts posted do not harm the legitimate interests of third parties. In this regard, users agree to:
Not defame, abuse, harass, insult, or threaten anyone, and not violate the rights of third parties;
Not use obscene, aggressive language, or insults through the platform;
Not promote, without Klépierre's express authorization, brands, stores, businesses, products, or services;
Not defend or praise crimes against humanity or incite racial hatred or pedophilia;
Not create a false identity or use the identity of third parties;
Not transmit viruses, trojans, or any other harmful or destructive programs;
Not impede the proper functioning of the Digital Platform;
Not violate the privacy or image rights of other users of the Platform;
Generally, not transmit content that infringes intellectual property rights or the rights of third parties, particularly trademarks, privacy, or copyrights.
The user must indemnify Klépierre Management against any legal action, directly or indirectly based on the comments and/or data entered by users, that may be initiated against Klépierre Management by anyone. Specifically, they agree to cover all expenses, including legal costs, arising from an action by a third party against Klépierre Management.
3.7 Responsibility Within the limits of the law, Klépierre Management is not responsible for content published online by users on the Digital Platform. Klépierre Management uses moderators whose role is to moderate user comments. Moderation is performed post-publication (ex post). The choice for ex post moderation is due to the practical impossibility, due to the instant nature and volume of content, to exercise general prior control over all content. The principle of ex post moderation promotes freedom of expression for users, who must be responsible and ensure compliance with applicable laws and regulations. The user acknowledges that Klépierre Management reserves the right to remove all or part of the content posted at any time and for any reason, without prior notice or justification.
